Federal judge denies bail for Nigerian man accused of being a stowaway
LOS ANGELES - A federal judge in Los Angeles today denied bail for a Nigerian American man accused of flying from New York City to Los Angeles International Airport using an expired boarding pass issued to someone else.Olajide Oluwaseun Noibi, 24, was arrested Wednesday morning at Los Angeles International Airport on a federal charge of being a stowaway aboard an aircraft, said FBI spokeswoman Laura Eimiller. The charge carries a maximum prison sentence of five years.
In denying bail for Noibi, U.S. Magistrate Judge Michael R. Wilner said the defendant appears to be a flight risk and a potential danger to the community. The judge also said there was some confusion about Noibi's identity and residence.
"I'm not sure I understand what's going on here," Wilner said, adding that he could not set bond based on such an "absence of information" about the defendant.
A Facebook profile appearing to belong to Noibi describes him as an African missionary and a frequent flyer.
Noibi was allegedly caught Friday using an outdated boarding pass with a different name on it to get on a Virgin America flight from JFK Airport to LAX. The flight crew became suspicious of Noibi during the flight, and he was questioned on the ground in Los Angeles, but was released.
Wednesday, he allegedly tried to do the same thing again. This time, it was on a Delta flight to Atlanta, but he was never able to get on a plane. Authorities say they found between 10 and 15 boarding passes issued in the names of other people in his possession.
Assistant U.S. Attorney Edward Alon, arguing for detention, said Noibi is "an identity thief" with "an admitted interest in travel for free" who "attempted to pass himself off (as someone else) to get into secured areas" of various airports.
Alon said Noibi could pose a risk to others if he was to be discovered and confronted by authorities while stowing away aboard a jet.
"I would not want to be present at 30,000 feet when he is discovered," Alon said.
Noibi, wearing a green jail-issued windbreaker, hands shackled to his waist, made no reaction during the hearing.
In arguing for bail, defense attorney Carl Gunn said Noibi had relatives in Hayward and Michigan, but conceded that their commitment to providing sureties for the defendant was minimal at this point.
"It's a pretty respectable family and they're a little freaked out" by the publicity surrounding the case, Gunn told the court.
